Terms of Service

1. Agreement to Terms

By accessing or using SafePlay Compliance Hub (‘the Service’), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Service. The Service is operated by Hotline Labs Ltd (Company No: 11873778).

2. Description of Service

SafePlay Compliance Hub is a cloud-based compliance management platform designed for soft play centres, trampoline parks, and indoor activity venues. The Service includes equipment tracking, staff compliance management, document storage, daily safety checklists, automated reminders, and compliance dashboard features.

3. Account Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use.

4. Free Trial

We offer a 14-day free trial with full access to the Service. You select a plan and provide card details when you create your account. No payment is taken during the trial period.

At the end of the 14th day your trial converts automatically to the plan you selected, and the first payment is taken on the following day. We will email you at least three days before that first payment is taken, stating the date and the amount.

You may cancel at any time during the trial from the Billing section of your account. If you cancel before the trial ends, no payment is taken and you owe us nothing. One trial is available per venue operator.

5. Subscription & Billing

Paid plans are billed monthly or annually in advance, on the plan and billing period you selected at signup. Prices are in British Pounds (GBP) and are the total amount payable: the price shown at signup is the price charged. If VAT becomes applicable in future we will give at least 30 days’ notice before it is added. Payments are collected and processed by Stripe. We do not store your full card number.

Renewal is automatic. Monthly plans renew on the same day each month and annual plans on the same date each year, until you cancel. We will give you at least 30 days’ notice by email before any price change, and any change applies from your next renewal.

If a payment fails we will retry it and email you. If it remains unpaid after our retries are exhausted, your account becomes read-only: you can still read and export all of your records, but you cannot add or edit them until the outstanding amount is settled.

6. Cancellation & Refunds

Cancelling your subscription. You may cancel at any time from the Billing section of your account. Cancellation takes effect at the end of the billing period you have already paid for, and you keep access until then. We do not refund part-used billing periods.

Cancelling during the free trial. Cancel at any point before the trial ends and no payment is taken.

Your statutory right to cancel. If you are an individual contracting outside your trade, business, craft or profession, you have a legal right to cancel within 14 days of entering into the contract, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You may tell us in writing at legal@safeplayhq.com. Because you ask us to begin providing the Service immediately when you create your account, if you cancel during this period we may charge you a proportionate amount for the service supplied up to the point you told us. During the free trial that amount is nil. This right is in addition to, and does not limit, the cancellation rights above.

Most SafePlay customers contract as a business, and this statutory right will not apply to them. Nothing in these terms removes it from anyone who does have it.

After cancellation. Your data is retained for 90 days so you can reactivate or export it, then permanently deleted. Please export your records before the 90 days elapse if you need them. Billing records, including invoices, are retained for six years as required by UK tax law, even after your account data is deleted.

7. Your Responsibilities

You are responsible for: the accuracy of data entered into the Service; ensuring your use of the Service complies with applicable laws and regulations; maintaining appropriate backup copies of your data; and ensuring that your team members who access the Service comply with these terms. The Service is a compliance management tool, not a substitute for professional safety advice.

8. Data Ownership

You retain ownership of all data you upload to or create within the Service. We do not claim any intellectual property rights over your data. You grant us a limited licence to process your data solely for the purpose of providing the Service.

9. Service Availability

We aim to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible. We are not liable for any loss or damage caused by service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law, Hotline Labs Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Intellectual Property

The Service, including its design, features, code, and branding, is the intellectual property of Hotline Labs Ltd. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written consent.

12. Changes to Terms

We may update these terms from time to time. We will notify you of material changes by email or by posting a notice within the Service. Continued use of the Service after changes constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
